End-User License Agreement

This End-User License Agreement ("Agreement") is a legal agreement between you ("you" or "Licensee") and Go-Forth Galaxy ("Go-Forth Galaxy," "we," "us," or "our") governing your access to and use of any software, applications, tools, or related documentation that we make available and that reference this Agreement (collectively, the "Software"). By downloading, installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not access or use the Software.

1. License Grant

Subject to your compliance with this Agreement, Go-Forth Galaxy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software solely for your internal business purposes and only as expressly permitted by us. All rights not expressly granted are reserved by Go-Forth Galaxy.

2. Restrictions

You agree that you will not, and will not permit others to:

• copy, modify, adapt, translate, or create derivative works of the Software except as expressly permitted;
• reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent such restriction is prohibited by law;
• rent, lease, lend, sell, sublicense, distribute, or otherwise make the Software available to any third party;
• remove, alter, or obscure any proprietary notices on the Software;
• use the Software to build a competing product or service, or in any unlawful manner or in violation of any third-party rights; or
• circumvent or disable any security, licensing, or usage-control features of the Software.

3. Ownership

The Software is licensed, not sold. Go-Forth Galaxy and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to trademarks, logos, or service marks of Go-Forth Galaxy.

4. Third-Party Components

The Software may include third-party or open-source components that are subject to their own license terms. Those terms govern your use of such components and, in the event of a conflict with this Agreement, control with respect to those components.

5. Updates and Support

We may, but are not obligated to, provide updates, upgrades, or support for the Software. Any updates we provide are governed by this Agreement unless accompanied by separate terms. We may modify, suspend, or discontinue the Software, in whole or in part, at any time.

6. Term and Termination

This Agreement is effective until terminated. It terminates automatically if you breach any of its terms, and we may suspend or terminate your license at any time. Upon termination, you must stop using the Software and destroy all copies in your possession or control. Sections that by their nature should survive termination will survive.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO-FORTH GALAXY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THIS AGREEMENT WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Go-Forth Galaxy and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Software or your breach of this Agreement.

10. Governing Law

This Agreement is governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Guilford County, North Carolina will have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement, and you consent to their jurisdiction.

11. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Software after changes take effect constitutes acceptance of the revised Agreement.

12. Entire Agreement; Severability

This Agreement is the entire agreement between you and Go-Forth Galaxy regarding the Software and supersedes all prior understandings on that subject. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
